General Terms and Conditions Alpecin Shop – Status 05/13/2025

§ 1 Scope

(1) These General Terms and Conditions (hereinafter referred to as "GTC") of Dr. Kurt Wolff GmbH & Co KG, Johanneswerkstraße 34-36, 33611 Bielefeld, Germany, HRA 11533 (hereinafter referred to as "Dr. Wolff/we/us"), in the version valid at the time of the order, shall apply to your orders for goods in the Alpecin International Shop, alpecin.com/en-int (hereinafter referred to as "Shop"). 

(2) The conditions for the use of promotional vouchers can be found in these GTC under § 8. 

(3) A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity. 

(4) An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction. 

(5) Our products are only sold for private use in normal household quantities. You therefore warrant that you will not use the items purchased via the store for resale in commercial transactions, i.e. that you will not resell them commercially. 

(6) You can download, save or print the GTC as a PDF. 

(7) Regulations and conditions deviating from these GTC shall only apply if they have been expressly confirmed by us in text form in individual cases. 

(8) We may update or amend these GTC from time to time. You can view the current version of the GTC at any time. To the extent required by law, Dr. Wolff will inform you of such changes. For your purchase in the store, the current version of the GTC shall apply. 

§ 2 Contract language

(1) The language available for the conclusion of the contract is exclusively English. 

Translations of these terms and conditions and the information in the store in other languages are for your information only. In the event of any differences between the language versions, the English text shall take precedence. 

(2) Obvious errors and oversights shall not bind Dr. Wolff. 

§ 3 Conclusion of contract

(1) All offers in the store are non-binding (so-called invitation to order/invitatio ad offerendum) and therefore serve to submit a binding offer by the customer. 

(2) As part of the order process , you first place the desired goods in the shopping cart. There you can change the desired quantity at any time or remove selected goods or services completely. If you have placed goods in the shopping cart, clicking on the "Continue" buttons will first take you to a page where you can enter your details and then select the shipping and payment method. Finally, an overview page opens where you can check your order details.  

You can correct input errors (e.g. regarding payment method, dates or the desired quantity) by clicking on "Edit" in the respective field. If you wish to cancel the order process completely, you can also simply close your browser window. Otherwise, after clicking on the confirmation button "Order with obligation to pay", your declaration becomes binding as an offer. By declaring your offer, you agree to an exclusively electronic invoice transmission. 

(3) We can accept your offer within 5 working days 

(i) by sending you an order confirmation ("order confirmation") by e-mail to the e-mail address you have provided or in writing, whereby the receipt of the order confirmation by you is decisive in this respect, or 

(ii) by delivering the ordered goods to you, whereby the receipt of the goods by you is decisive in this respect. If several of the aforementioned alternatives exist, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first. 

§ 4 Prices

The prices listed at the time of ordering apply. The prices quoted are final prices. They include the applicable statutory value added tax. 

§ 5 Storage of the contract text

The contractual provisions with details of the goods ordered and/or services booked, including these General Terms and Conditions and the cancellation policy, will be sent to you by e-mail with the order confirmation. We do not save the contractual provisions. 

§ 6 Delivery

(1) We deliver your goods order exclusively to the areas listed at here. 

(2) Information on shipping costs can be found during the ordering process and here.
Deliveries with an order value of 45 € or more are free of shipping costs.

(3) Standard deliveries are made to the delivery address specified in an order. 

(4) You will be informed about the expected shipping time on the respective product page before placing the order. 

(5) As a rule and if possible, your order will be delivered in one shipment. However, partial deliveries are possible after prior notification if a complete delivery cannot be made. 

§ 7 Payment

We offer the following payment methods to pay for your order: Card payment (VISA, Mastercard, Maestro, American Express, Union Pay), PayPal, ApplePay, GooglePay, Klarna invoice. When paying via PayPal, you have the option "Pay only after 30 days". 

§ 8 Promotional vouchers

(1) Promotional vouchers are vouchers/discount codes ("promotional vouchers") that are issued as part of a marketing campaign/measure with a specific validity. The provisions on the promotional vouchers apply in addition to and take precedence over these GTC. 

(2) Promotional vouchers can be redeemed once by entering the promotional code in the order process. One promotional voucher can be redeemed per order. Multiple promotional vouchers cannot be combined with each other. 

(3) Subsequent redemption of the promotional voucher after completion of the order is not possible. 

(4) The order value must be at least equal to the discount granted by the promotional voucher. 

(5) The discount granted with the promotional voucher will not be paid out in cash. The promotional voucher will not be refunded if goods are returned in whole or in part. 

(6) The promotional voucher may not be transferred to third parties. Dr. Wolff accepts no liability for loss, theft or illegibility of the promotional voucher. 

§ 9 Retention of title

The delivered goods shall remain the property of Dr. Wolff until payment has been made in full. Prior to the transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without our consent. 

§ 10 Warranty

(1) If the goods purchased and delivered in our online store are defective, you are entitled to demand subsequent performance, withdraw from the contract or reduce the purchase price within the framework of the statutory provisions. 

(2) The limitation period for warranty claims for the delivered goods is two years from receipt of the goods. Claims for defects which we have fraudulently concealed shall become statute-barred within the regular limitation period. 

(3) An additional guarantee only exists if this was expressly stated in the order confirmation for the respective article. 

§ 11 Limitation of liability

(1) We are liable for intent and gross negligence. Furthermore, we shall be liable for the negligent breach of obligations, the fulfillment of which is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract and on the observance of which you as the customer may regularly rely. In the latter case, however, we shall only be liable for the foreseeable damage typical of the contract. The same applies to breaches of duty by our vicarious agents. 

(2) The above exclusions of liability shall not apply in the event of injury to life, limb or health. The above exclusions of liability shall also not apply if a defect has been fraudulently concealed or if we have assumed a guarantee for the quality of the item. 

(3) Liability under the Product Liability Act remains unaffected.

§ 14 Dispute resolution

(1) The European Commission provides a platform for online dispute resolution (OS), which can be accessed here: Online Dispute Resolution | European Commission (europa.eu). This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved. 

§ 15 Applicable law

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods if 

(a) you have your habitual residence in Germany, or 

(b) your habitual residence is in a country that is not a member of the European Union. 

(2) In the event that you have your habitual residence in a member state of the European Union, German law shall also apply, whereby mandatory provisions of the state in which you have your habitual residence shall remain unaffected.
